TITLE I.

COMMON PROVISIONS

article 1

object

The aim of this directive is to approximate the laws and regulations of the Member States for

the ingredients and emissions of tobacco products and the associated reporting requirements, including the emission ceilings for tar, nicotine and carbon monoxide from cigarettes;

certain aspects of the labeling and packaging of tobacco products, including the health warnings that must appear on the packs and the outer packaging of tobacco products, and the traceability and safety features that are applied to tobacco products to ensure their compliance with this Directive;

the ban on marketing tobacco for oral use;

the cross-border sales of tobacco products at a distance;

the obligation to report novel tobacco products;

the placing on the market and the labeling of certain products that are related to tobacco products, namely electronic cigarettes and refill containers as well as herbal smoke products,

thus - based on a high level of protection of human health, especially for young people - the smooth functioning of the internal market for tobacco products and related products is facilitated and the obligations of the Union under the WHO Framework Convention on Tobacco Control (Framework Convention on Tobacco Control, hereinafter referred to as “FCTC”) are complied with.

Article 2

Definitions

For the purposes of this guideline, the term

“Tobacco” leaves and other naturally processed or unprocessed parts of the tobacco plant, including expanded and reconstituted tobacco;

“Pipe tobacco” means tobacco that can be consumed by means of a combustion process and is intended solely for use in a pipe;

"Roll your own tobacco" means tobacco that can be used by consumers or retail outlets to make cigarettes;

"Tobacco product" means a product which can be consumed and which consists, even partially, of genetically modified or genetically unmodified tobacco;

"Smokeless tobacco product" means a tobacco product that is not consumed through a combustion process, including chewing tobacco, snuff and tobacco for oral use;
